Terms of Service

These Terms of Service ("Terms") govern your access to and use of Skapeo, available at skapeo.com and app.skapeo.com (the "Service"), operated by the Skapeo team ("Skapeo", "we", "us").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Skapeo lets outdoor contractors turn a photo of a project area into a photorealistic visual of the finished result, and share it with their clients through a shareable link ("Client Link"). The Service may evolve over time as we add, change, or remove features.

To produce visuals, photos you upload are processed using third-party technical providers. Some of these providers may be located outside the European Union. See our Privacy Policy for details.

2. Eligibility and accounts

You must be at least 18 years old and able to enter into a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity under your account.

You may use the Service only for lawful business purposes and only for content you have the right to use.

3. Plans, pricing, and billing

The Service is offered through the following plans:

• Discovery: free, includes a limited number of projects to try the Service. No card required.
• Pro: paid plan, billed monthly or annually.
• Business: paid plan for teams, billed monthly or annually.

Prices are shown on our pricing page and are stated in US dollars (USD). Payments are processed by our payment provider, Stripe. By subscribing to a paid plan, you authorize us to charge the applicable fees to your payment method.

3.1 Subscription and automatic renewal

Paid plans are subscriptions billed in advance for the chosen billing period (monthly or annual). Subscriptions renew automatically at the end of each billing period at the then-current rate, unless you cancel before the renewal date.

For annual plans, the full annual amount is charged at the start of the billing period and renews annually.

3.2 Cancellation

You can cancel your subscription at any time from your account settings. Cancellation stops the next renewal. Your access continues until the end of the billing period you have already paid for. Cancellation does not, by itself, entitle you to a refund of the current period (see our Refund Policy).

3.3 Promotions

Promotional offers and discount codes are subject to their own conditions, may be limited in time, and may be modified or withdrawn at any time. A promotional rate applies only as stated and does not carry over to renewals unless expressly indicated.

3.4 Price changes

We may change our prices. If a change affects your subscription, we will give you reasonable notice before it applies to your next renewal.

4. Your content

You retain ownership of the photos you upload and the visuals you generate ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to provide and improve the Service, including transmitting photos to the technical providers needed to produce your visuals.

You are responsible for having the necessary rights and permissions for any photo you upload, including the consent of any person or property owner where required.

5. Acceptable use

You agree not to use the Service to upload unlawful content, infringe the rights of others, attempt to disrupt or reverse-engineer the Service, resell or redistribute the Service without authorization, or use it in any way that violates applicable law.

6. Intellectual property

The Service, including its software, design, and the Skapeo brand, is owned by Skapeo and protected by law. These Terms do not grant you any right to our intellectual property beyond the limited right to use the Service.

7. Availability and changes

We aim to keep the Service available and reliable but do not guarantee uninterrupted access. We may modify, suspend, or discontinue parts of the Service, and will give reasonable notice where a change materially affects paid users.

8. Disclaimers and liability

The Service is provided "as is". Visuals produced by the Service are representations intended to help present a project and may differ from the final built result. To the fullest extent permitted by law, Skapeo is not liable for indirect or consequential damages, or for business decisions made based on visuals produced with the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

9. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms. Provisions that by their nature should survive termination will survive.

10. Governing law and disputes

These Terms are governed by French law. The parties will seek to resolve any dispute amicably. Where mandatory consumer protection rules apply, your statutory rights are not affected.

11. Changes to these Terms

We may update these Terms. We will post the updated version with a new "last updated" date and, where appropriate, notify you. Continued use after changes means you accept the updated Terms.
